Guide for property managers: the asbestos certificate

Law 8/2026 gives property managers (administradores de fincas) a specific role: reporting asbestos in the buildings they manage, ensuring that owners provide the certificate when selling or renting, and helping them obtain it (art. 12). This guide summarises those duties and how to organise them.

What the law requires of property managers

Article 12.1 of Law 8/2026 states that property managers must:

  • Report the presence of asbestos-containing materials in the buildings they manage to the owners and to the bodies responsible for the Catalan census of asbestos-containing materials (a).
  • Ensure that owners provide the asbestos presence or absence certificate to whoever buys or rents, and assist them in obtaining it (b).
  • Inform owners about grants and subsidies offered for managing and removing asbestos (c).
  • Help spread the authorities’ protocols and guides (d) and cooperate with inspections (e).

The flat’s certificate and common areas

When an owner sells or rents their flat or unit, the certificate covers only that unit, as the Catalan Waste Agency points out. Shared roofs, façades or downpipes are not included in it.

Asbestos in common elements is a matter for the owners’ association. Town councils must draw up a census of installations with asbestos with a removal timetable (14th additional provision of Act 7/2022), and removal may only be carried out by RERA-registered companies (Royal Decree 396/2006).

How to organise it in your office

  1. Identify which buildings in your portfolio were built before 2002.
  2. Tell their owners about the obligation when selling or renting (a circular is enough).
  3. Offer a go-to provider for the certificate, so owners do not have to look for one.
  4. If you know of asbestos in common elements, report it to the owners and the Catalan census, and tell them about available grants.

How we work with property managers

  • Certificates for the owners in your buildings, with a single point of contact.
  • We coordinate the visit with the owner or tenant.
  • Volume pricing and a single monthly invoice.
  • For whole buildings, a quote first.
